1、拆迁协议书一般情况下应使用省、市（县）人民政府房地产管理部门统一印制的文本，其内容主要包括：补偿形式和补偿金额，付款方式和付款期限，安置用房的面积、地点和层次，搬迁过渡方式和过渡期限，违约责任，当事人认为应当订立的其他条款。
2、拆迁协议书签订后，必须送房屋拆迁主管部门备案，并可向公证机关办理公证。
3、但在拆除依法代管的房屋时，代管人是房屋拆迁主管部门的，补偿、安置协议必须经公证机关公证，并应当办理证据保全。同时，被拆迁人应将原有土地使用证、房屋所有权证或者使用证明交给拆迁人，由拆迁人交房地产权属管理部门办理注销登记手续。
